These Terms of Service ("Terms") govern your use of flight-foods.com (the "Site") and your purchase of products from Flight Foods LLC ("Flight Foods," "we," "us" or "our"), a Florida limited liability company. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to make a purchase. Our products are intended for healthy adults.

2. Supplement disclaimer

Statements on this Site have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. Information on the Site is for general educational purposes and is not medical advice.

Consult a qualified healthcare professional before using any dietary supplement, especially if you are pregnant or nursing, under 18, taking medication, have a medical condition, or are sensitive to caffeine or other stimulants. Read every label and follow directions and warnings. Do not exceed the recommended serving. Stop use and consult a doctor if you experience any adverse reaction. Individual results vary, and testimonials or athlete stories are not a guarantee of results.

3. Products, pricing and availability

We try to describe products, ingredients, images and prices accurately. Product formulas and packaging may change, so always rely on the label on the product you receive. Prices are in U.S. dollars and may change at any time without notice. We reserve the right to limit quantities, discontinue products, refuse or cancel orders (including orders that appear fraudulent or were placed at a price shown in error), and correct errors. If we cancel an order after you have been charged, we will refund you.

4. Orders and payment

When you place an order, you agree that the information you provide is accurate and that you are authorized to use the payment method. Your order is an offer to buy, which we accept when we ship it. Applicable sales taxes and shipping charges are shown at checkout.

5. Subscriptions

Some products are offered on a recurring subscription ("Subscribe and save"). By choosing a subscription, you authorize us and our payment processor to charge your payment method automatically at the frequency you select, at the subscription price then in effect plus applicable taxes and shipping, until you cancel. Your subscription renews automatically.

• You can skip, change, pause or cancel your subscription at any time from your account, or by emailing thomas@flight-foods.com. To avoid the next charge, cancel before your next billing date.
• We will notify you before any change to your subscription price.
• Subscription discounts may not combine with other offers.
• If a payment fails, we may retry the charge or pause the subscription.

6. Promotions and discount codes

Promotions and discount codes are subject to their stated terms, may be limited in time or quantity, have no cash value, and may be changed or ended at any time.

7. Shipping, returns and refunds

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy, which allows returns of unopened products within 30 days of delivery. Title and risk of loss pass to you when we deliver the products to the carrier.

8. Accounts

You are responsible for keeping your account login secure and for activity under your account. Tell us right away if you believe your account has been used without permission.

9. Reviews and user content

If you submit reviews, photos, comments or other content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce and distribute it in connection with our business. You confirm the content is truthful, is yours to share, and does not violate any law or anyone's rights. We may remove content at our discretion. Reviews must reflect your genuine experience.

10. Intellectual property

The Site and its content, including the Flight Foods name, logos, product names, designs, text, images and graphics, are owned by or licensed to Flight Foods and are protected by intellectual property laws. You may not copy, modify, distribute or use them without our written permission. Scripture quotations are used for devotional purposes and remain subject to the rights of their publishers.

11. Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, using automated tools to collect data, reselling products without authorization, or using the Site for any unlawful purpose.

12. Third-party services

The Site uses third-party services such as payment processors, apps and the Flight Fitness app on the Apple App Store. Your use of those services is subject to their own terms. We are not responsible for third-party services.

13. Disclaimer of warranties

Except as expressly stated in these Terms or required by law, the Site and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will be uninterrupted or error-free.

14. Limitation of liability

To the fullest extent permitted by law, Flight Foods and its owners, employees, athletes and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or products. Our total liability for any claim relating to the Site or products will not exceed the amount you paid for the products giving rise to the claim. Some states do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Flight Foods from claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site or products.

16. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days.

17. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page. Your continued use of the Site after changes are posted means you accept the updated Terms.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies referenced above, are the entire agreement between you and Flight Foods regarding the Site.
